Kanawha teen indicted on fatal DUI charge

CHARLESTON, W.Va. -- A 19-year-old has been indicted on a charge of DUI causing death after a wreck on Hughes Creek Road in July left a Riverside High School student dead.

Dustin Burkhardt, of London, was driving the car that wrecked and resulted in the death of Colin Qualls, 16, of Glasgow.

Qualls died shortly after the wreck. Four other teenagers who were in the car were also hospitalized, according to police.

The car went through a fence, took out a gas line and struck concrete steps at 5211 Hughes Creek Road. Qualls' body was found lying in a neighbor's yard.

After the wreck, Burkhardt posted on his Facebook page, "It should've been me. Truly will never be able to live with myself."

In all, a Kanawha County grand jury indicted 81 defendants on Jan. 17. An indictment is not a finding of fact; it only means that grand jurors have decided that enough evidence exists to warrant a criminal trial.
