Man gets 2-year term for attacking girlfriend
CHARLESTON, W.Va. -- A Charleston man will spend at least two years in prison for ambushing his girlfriend at her home and beating her unconscious.
Kanawha County Circuit Judge Charles E. King sentenced Franklin Davis, 22, to two to eight years in prison Monday for what prosecutors said was a "brutal, relentless, vicious attack" on his girlfriend, Amy Smith.
In January, Smith called police to her home on Crescent Road after alleging that her boyfriend had forced his way inside and beat her until she blacked out. Days earlier, Smith had filed a protective order against Davis.
Davis, according to police, left the house while Smith was unconscious.
"Ain't no excuse for what I did," Davis said Monday. "I put my hand on her, I hit her."
After King handed down the sentence, Davis spent several minutes pleading with the judge to reduce his prison time. King said he would consider a motion to reduce the sentence if Davis' lawyer files a motion.
