CHARLESTON, W.Va. -- Another Kanawha County bar faces a misdemeanor charge for allegedly violating the county's 3-month-old smoking ban.
The Kanawha-Charleston Health Department has filed a criminal complaint against the Kanawha City Cantina, 4102 MacCorkle Ave. S.E., in Charleston.
Health Department sanitarians found cigarette butts in a cup, and ashes by a pool table at the bar during a surprise inspection last week, according to the complaint. The Cantina previously received a warning from the Health Department about smoking violations.
The bar's owner, Tina Jenkins, could not immediately be reached for comment.
Jenkins was ordered to appear Nov. 3 in Kanawha County Magistrate Court to answer the complaint, which was filed late Wednesday afternoon.
Her husband, Keith, has been an outspoken critic of the smoking regulations during recent health board meetings.
Last week, the Health Department filed criminal complaints against McNalley's Pub in Cross Lanes, Lisa's and the Moose Lodge in Nitro, and the Hot Spot Coffee Shop and Blackhawk Saloon in Charleston.
The charges were the first enforcement actions taken by the Health Department since the smoking ban took effect July 1.
Bars and gambling parlors face fines of $200 to $2,000, if found guilty. The Health Department has threatened to pull health permits from businesses that repeatedly violate the smoking ban.
