Lawsuit filed in teacher retirement 'mess'

CHARLESTON, W.Va. -- A lawsuit on behalf of teachers allegedly misled into investing their retirement savings in low-interest annuities has been filed in Marshall County.

"I want to follow the money. I want to see who made the big bucks on the deal," lawyer Harry Bell said of the suit against the parent company of the Variable Life Insurance Co.

"The people responsible for taking advantage of the teachers, and creating this whole mess should step up to the plate and pay," he said.

The suit by Bell and Charleston lawyer Rusty Webb contends that representatives of VALIC misled thousands of participants in the 401(k)-style Teachers Defined Contribution plan to invest heavily or entirely in their low-interest rate annuities in the early 1990s. VALIC has since been acquired by AIG Retirement.

Earlier this year, the Legislature passed a law allowing any of the 19,000 teachers and service personnel stuck with severely underfunded TDC plans the option to transfer into the Teachers Retirement System, a defined benefits plan.

Bell he is optimistic the court will certify the case as a class-action suit.

"I have had hundreds, if not thousands, of calls and contacts with people every day," he said. "I've signing confirmation letters that they're going to go with us."

Bell said he doesn't believe the transfer of nearly 15,000 TDC participants into TRS last month will affect the lawsuit.

There are many people in the TDC who don't have many more years until retirement and time is the key factor to building wealth in a plan like the TDC. They are very fortunate that they were allowed to transfer back.

Many people these days don't plan for their retirements like they should & don't take the intiative to learn about investments. There is no excuse for that, especially when they are our educators. Learning is their business, so why can't they read a book, watch a tv program or research the internet to find out how best to save for their retirement? The participants who invested in the annuity option should take responsibility for their own actions. Even if they had to decide the intial investments quickly, the TDC allows you to redirect your investments with a click of the mouse.

In addition, Valic should be held resposible for misleading people intentionally and CPRB should never have offered an annuity option in the first place.

All three parties are to blame.

Joe6Pk is a prime example of the stereotypical West Virginia who doesn't read. Most of these employees had no choice in their retirement options. Others were given a few minutes during their plan periods to make their decisions, and trusted the VALIC employees who led them down the path of retirement destruction.

Personally, I'm not involved, but I do hope that this lawsuit will point the finger at those who stood to make big bucks on this deception.

Right on Joe6P, these are supposed to be educators we are talking about. They should have educated themselves before biting. Problem was, they thought they would get something for nothing. Another "teacher tax" is comming our way!

CPRB, with the exception of a couple of quality people, they are one of the most inept agencies in State Government. They have no leadership, and those that do care for the common person get the worst jobs and the most work dumped on them. No wonder the retirement system is such a mess. The membership side of the agency doesn't do anything other than collect a paycheck....Pathetic
